An update on the progress of Draft Willoughby Local Environmental Plan 2009 was considered at the Council Meeting of 12 December 2011.

The following report on the submissions received during exhibition of the Draft Willoughby Local Environmental Plan 2009, Draft amendments to Willoughby Development Control Plan and other documents was considered at a Special Meeting of Council on 3rd November 2010 at 6.30pm in the Council Chambers, Level 6, 31 Victor Street, Chatswood. The minutes of the meeting are included below. The report includes a review of the submissions and amendments to the draft plans.

The Draft Willoughby Local Environmental Plan 2009 (Draft WLEP 2009) and other documents were on exhibition from Thursday 25 March to Thursday 20 May 2010. The purpose of the exhibition was to inform the community about the new planning controls. Information about the draft plan, related documents and maps can be found within this section of the website.

Please note that  the Draft WLEP 2009 affects all properties in the Willoughby Local Government Area .

All property owners have been sent a notification letter which provides information on their existing and proposed zones. Please carefully read the information in these pages to see which changes apply to your property and your neighbourhood.

When adopted, the WLEP 2009 will replace the existing WLEP 1995 and Sydney Regional Environmental Plan No 5 (Chatswood Town Centre).

In addition to the Draft WLEP 2009, the following were also on exhibition:

  • Draft amendments to the Willoughby Development Control Plan to reflect the new Draft WLEP 2009 controls for business centres as well as other changes to the WDCP
  • Chatswood Vision and Strategic Plan
  • Chatswood CBD Strategic Plan Background Report
  • Draft Willoughby Structure Plan
  • Information concerning a proposed three per cent developer contribution levy for the Chatswood CBD to contribute to the cost of funding CBD improvements
  • Council's proposal to apply its affordable housing policy to land being zoned for residential purposes or to higher residential density

What is a Local Environment Plan?

A Local Environment Plan (commonly known as an LEP) provides the statutory framework for all planning, development and building. The LEP outlines zoning types and development restrictions for land, and aims to conserve local heritage and protect sensitive land.  The LEP is made up of a written instrument and maps.

How is your property affected?

To find out how your property is affected by the Draft WLEP 2009:

FIrst check out the maps and find out the name of the new zone.
You should also check the other maps such as Height of Buildings, Floor Space Ratio, Heritage and Conservation etc for other development controls which may apply to your land.

Check the written instrument to find out what controls apply to the zone and to your particular site.  (A plain English version of the written instrument is also available.)

Why are the WLEP 1995 and SREP 5 being revised?

Previously, all councils in NSW have developed their own zone names and controls. In 2006, the NSW Government issued a requirement that all NSW councils prepare an LEP consistent with a Standard Instrument LEP format Order 2006. As a result, all councils will use the same zone names and to some extent, the same compulsory controls in the Standard Instrument.

Additional objectives and local controls have been added by Council, with the approval of the Government’s Department of Planning. Willoughby Council is required to revise its plan by 2011.
