Reclassification of Council Land

EXHIBITION OF DRAFT WILLOUGHBY LOCAL ENVIRONMENTAL PLAN -RECLASSIFICATION OF LAND FROM COMMUNITY TO OPERATIONAL AT LOT H DP 30947 CASTLE COVE, LOTS 14 AND 15 DP 4639 BARTON ROAD ARTARMON AND PART LOT 5 DP 69948 CHATSWOOD.

Pursuant to the provisions of Section 66 and Section 72 of the Environmental Planning and Assessment Act, 1979 NOTICE is hereby given that the Draft Willoughby Local Environmental Plan 2009 (Draft WLEP 2009) is now on exhibition. The purpose of Schedule 4 of Draft WLEP 2009 is to reclassify certain Council owned land from community to operational. The sites proposed to be reclassified are located at:

  • Lots 14 & 15 DP 4639 - Barton Road, Artarmon
  • Lot H DP 30947 - Castle Cove Drive, Castle Cove
  • Lot 5 DP 69948 – Currey Park, Victor Street, Chatswood

The draft Plan has been placed on exhibition for public comment.

As part of the process for the reclassification, a public hearing is to be held into the Draft Willoughby Local Environmental Plan 2009 by an independent assessor in accordance with Section 68 of the Environmental Planning and Assessment Act 1979 and Section 29 of the Local Government Act 1993.

This hearing will commence at 10am, Wednesday 16 June 2010 in the Council Chambers on Level 6 at Council’s Administration Building, 31 Victor Street, Chatswood. Should you wish to make representations at this public hearing, please contact Council’s Strategic Planning Branch on 9777 1000, or request to make representations to the public hearing in your written submission.

Report on the Public Hearing

Note:

Under the Local Government Act 1993, all public land must be classified as either “community” or “operational”. Community land cannot be leased for more than 21 years or sold. In order to dispose of community land, it must be reclassified through an LEP and a public hearing be held.

It is a requirement of the Local Government Act 1993 to hold a public hearing to reclassify land from community to operational. The required public hearing must be conducted by an independent assessor and the hearing would be held during the community exhibition period.
