NSW State’s Housing and Productivity Contribution
On 1 October 2023, the state government introduced the Housing and Productivity Contribution (HPC) that apply to certain residential, commercial and industrial developments applications (including DAs and CDCs) that are made on or after 1 October 2023. The HPC replaces the previous Special Infrastructure Contribution (SIC) in the NSW planning legislation that will fund the delivery of public infrastructure.
The HPC is in addition to the local council’s s7.11/s7.12 contributions. Please ensure all applicable local and state contributions are paid before the issue of Construction Certificate (for DA) or work commencement (for CDC).
Information about HPC charges, related conditions of consent and payment are as follow:
- HPC charge rates are available in the implementation guideline, and on the Department of Planning's website.
- Consent authorities and certifiers will be prompted to finalise the HPC for DA and CDC applications that trigger the contribution.
- Use the online estimator and quick reference guide to get an estimated calculation of the HPC obligations that may apply to a proposed development.
- Online payment of the HPC via the NSW Planning Portal (where a contribution is applicable).
- Consent authorities and certifiers will not be able to issue a Post-Consent Certificate if a HPC is required but has not yet been paid.
- Users will not be able to submit their Intention to Commence Work until the HPC has been paid for a related CDC.
Applications for high-density residential developments (residential flat buildings and shop top housing) that have been made before 1 October 2023 and did not seek approval for strata subdivision at the same time, will not be charged a HPC contribution when the subdivision application is subsequently made.
